Welcome to the Phantom Vibes Tech Affiliate Program! By joining, you agree to abide by these terms. Please read this agreement carefully before participating.
1️⃣ Introduction
These Terms & Conditions govern participation in the Phantom Vibes Tech LLC Affiliate Program ("Program"), administered by Phantom Vibes Tech LLC.
By enrolling, you acknowledge and agree to these terms.
2️⃣ Enrollment in the Program
✔ To join, complete and submit the affiliate application:

✔ Approval Process:
Phantom Vibes Tech LLC reserves the right to approve or reject applications for any reason, including but not limited to inappropriate, offensive, or illegal content.
✔ Identity & Email Verification Required:
Affiliates must verify their name and email before participation.
🚨 Failure to provide accurate verification may result in rejection or termination.
3️⃣ Responsibilities of the Affiliate
Affiliates must:
✔ Ethically and legally promote Phantom Vibes Tech products using official affiliate links.
✔ Comply with all applicable laws, including FTC guidelines on endorsements and disclosures.
✔ Honor the terms of the affiliate platform provider (e.g., Affiliatly) before Phantom Vibes Tech’s own terms. If conflicts arise, third-party affiliate platform rules take precedence.
✔ Ensure accurate tracking link usage—Phantom Vibes Tech LLC is not liable for missed commissions due to improper link use.
✔ Regularly check for updates to these terms and comply accordingly.
🚨 Violations may result in immediate termination from the program.
4️⃣ Affiliate Links & Marketing Restrictions
✔ Approved affiliates receive unique tracking links.
✔ Spam & unethical marketing tactics are strictly prohibited, including:
❌ Email spamming (unsolicited messages)
❌ Misleading advertising or false product claims
❌ Pop-ups, forced clicks, or deceptive redirects
❌ Trademark misuse or impersonation of Phantom Vibes Tech LLC
🚨 Violations may result in immediate termination and forfeiture of commissions.
5️⃣ Commission & Payment Structure
💰 Commission Rates
✔ Phantom Vibes Headset – 15% commission
✔ Merchandise (Apparel, Accessories, etc.) – 20% commission
✔ Digital Products (eBooks, Audiobooks, etc.) – 50% commission
💡 Commission Variability Disclaimer:
✔ Due to the different nature, origin, and profit margins of various products, commission rates may vary across categories.
✔ Phantom Vibes Tech LLC reserves the right to adjust commission rates at its discretion.
📅 Payment Terms
✔ Minimum Payout Threshold: $18
✔ Payment Methods: PayPal (or other approved applications).
✔ Payment Schedule: Payments are processed on a rolling basis, typically within 30 days of reaching the payout threshold.
🚨 Commission Payment Timing & Refund Protection
✔ To prevent losses from refunds or chargebacks, commissions are only paid after the refund eligibility period has passed.
✔ If an order is refunded or charged back before the payout date, the commission will not be paid.
✔ Digital product commissions will be held until the applicable refund period expires.
✔ Phantom Vibes Tech LLC reserves the right to adjust commissions if refund policies change.
🚨 Affiliates attempting chargeback fraud or commission disputes may be permanently banned.
6️⃣ Grounds for Immediate Termination
An affiliate may be immediately removed for:
🚨 Fraudulent Activity
❌ Self-referring for commissions (purchasing through their own link)
❌ Generating fake sales, leads, or traffic
❌ Misleading claims or false advertising
🚨 FTC Violations & Unethical Marketing
❌ Failure to disclose affiliate links (FTC requirement)
❌ Making false product claims or guarantees
❌ Spamming forums, social media, or email lists
🚨 Brand & Trademark Violations
❌ Using Phantom Vibes Tech branding, logos, or domain names without approval
❌ Running unauthorized paid ads (e.g., Google Ads on branded terms)
🚨 Association with Inappropriate Content
❌ Promoting on hate speech, violent, adult, or illegal sites
❌ Associating Phantom Vibes Tech LLC with pirated content, hacking, or fraudulent activities
🚨 Payment & Commission Fraud
❌ Attempting chargeback fraud or refund abuse
❌ Falsifying transaction data
🚨 Other Violations
❌ Ignoring compliance warnings or failing to respond to inquiries
❌ Long-term inactivity (6+ months with no sales)
🚨 If terminated for violations, unpaid commissions may be forfeited.
7️⃣ Limitation of Liability
✔ Phantom Vibes Tech LLC is not liable for indirect, incidental, or consequential damages, including:
❌ Lost profits
❌ Data loss
❌ Affiliate program participation issues
✔ Phantom Vibes Tech LLC does not guarantee affiliate success, earnings, or uninterrupted program functionality.
8️⃣ Modification of Terms
✔ Phantom Vibes Tech LLC reserves the right to update these terms at any time.
✔ Standard changes (e.g., commission rates, payment terms) → At least 7 days' notice via email.
✔ Emergency changes (e.g., fraud prevention, compliance fixes) → Immediate enforcement with notification ASAP.
9️⃣ Governing Law
✔ This agreement is governed by the laws of the United States.
✔ Any disputes will be resolved exclusively in US courts.
🔟 Independent Contractor Relationship
✔ Affiliates are not employees or representatives of Phantom Vibes Tech LLC.
✔ This agreement does not create a partnership, joint venture, or employment relationship.
1️⃣1️⃣ Indemnification
✔ Affiliates agree to indemnify and hold Phantom Vibes Tech LLC harmless from:
✅ Claims related to their marketing efforts
✅ FTC violations or false advertising claims
✅ Unauthorized use of Phantom Vibes Tech branding
🚨 Phantom Vibes Tech LLC reserves the right to take legal action against affiliates engaging in fraudulent or illegal activity.
1️⃣2️⃣ Severability
✔ If any part of this agreement is deemed unenforceable, the remaining terms remain valid.

By submitting your application and participating in the Phantom Vibes Tech Affiliate Program, you agree to these terms and conditions.
